Visa Refusals
a. Appeals to the Immigration Tribunal
Some immigration refusals carry a right of appeal, particularly those involving human rights grounds. Categories that may attract appeal rights include:
- Long residence (Paragraph 276B)
- Private life (Paragraphs 276ADE(1), 276DE, and Appendix PL)
- Family members under Appendix FM
- Children or partners of HM Forces personnel (Paragraphs 276U, 276AA, Part 4 or Part 7 of Appendix Armed Forces)
- Asylum claims (Part 11 of the Immigration Rules)
- Family routes under Part 8 where the sponsor is settled or holds refugee/humanitarian protection
Note: Even where appeals are allowed under the rules, the Home Office can certify the claim (e.g. under section 94 NIAA 2002), effectively removing the right of appeal. However, such certification can still be challenged.

b. Judicial Review (JR)
- Where no appeal right exists (e.g. certified decisions, delays, or unlawful refusals), applicants may challenge the decision by Judicial Review.
Judicial Review is a legal process where the lawfulness of a public body’s decision is reviewed by the Upper Tribunal (for immigration cases) or the Administrative Court. It is not a re-hearing, but a challenge based on legality, fairness, and procedure.
Key points:
- The decision must be by a public body
- JR must only be used if no other legal remedy (e.g., appeal, administrative review) is available
- Applications must be filed within 3 months of the decision being challenged

c. Administrative Review

Work & Study Visas
Skilled Worker Visa
The Skilled Worker route allows individuals with a job offer from a Home Office–licensed sponsor to work in the UK long-term. Applicants must meet strict requirements including minimum salary, appropriate skill level, and English proficiency. This route leads to settlement after five years.
High Potential Individual (HPI) Visa
Introduced in May 2022, the HPI visa targets global graduates from top 50-ranked non-UK universities. Applicants can stay for up to two years, or three years if they hold a PhD, with no job offer required. They must meet English and maintenance requirements and cannot extend within the scheme, but can switch to other visas leading to settlement.
UK Ancestry Visa
This visa allows Commonwealth citizens with a grandparent born in the UK to live and work there for up to five years. It leads to indefinite leave to remain if eligibility criteria such as work and residence are upheld.

Innovator Founder Visa
The Innovator Founder visa (introduced in April 2023) is designed for experienced entrepreneurs or specialists initiating innovative, viable, and scalable businesses in the UK. Key features include:
- 3-year initial stay, extendable indefinitely in successive 3-year blocks with re-endorsement.
- Leads directly to settlement after 3 years, subject to criteria satisfaction.
- Applicants must have endorsement from an approved body, prove involvement in the idea, hold English proficiency, and meet maintenance fund or investment thresholds (e.g., £1,270 personal savings; business development funding or £50,000+ in business investment).
- Regular “contact point” meetings with endorsers monitor ongoing business progress.
- Holders can work for their business, take on skilled secondary roles, study, and bring dependants.

Expansion Worker Visa
Part of the Global Business Mobility category, the UK Expansion Worker visa allows overseas companies to establish a UK presence by transferring experienced employees:
- Suitable for organisations opening a new UK branch or subsidiary within two years, with at least 3 years of international trading history.
- Applicants must be employees within the same group, have completed minimum overseas employment, and receive a sponsored CoS with 60 points under the GBM framework .
- Standard visa durations apply: up to 5 years, extended within the permitted total stay period.
